No Warranty – MeshWear Appeal Clothing and Products

There is no warranty, whether implied or express, on MeshWear Apparel Clothing and Products. These products are sold “as is” and are subject only to WeMesh, Inc.’s Return Policy. You may access the Return Policy here.

 

90-Day LIMITED WARRANTY – DaBo, DaBo Standard Top, & DaBo Inversion Top

WeMesh, Inc. (“WeMesh”) extends the following Limited Warranty, which applies only to non-commercial, in-home, indoor use, and indoor storage of the WeMesh products that include only the DaBo, DaBo Standard Top, and DaBo Inversion Top (collectively “DaBo”). Any other use of DaBo shall void this Limited Warranty. During the applicable Limited Warranty periods described below, the covered components of the DaBo will be free of defects or malfunctions during normal use and will comport with its published specifications. Certain exclusions apply, as further described in this Limited Warranty. This Limited Warranty does not extend to any non-personal use of DaBo in any commercial or medical setting, including, but not limited to, gyms, medical offices, physical therapy offices, or rehabilitation offices.

The Limited Warranty applies for the following components of the DaBo only, for the time period indicated. The Limited Warranty applies only against defects discovered within the applicable Limited Warranty period and only so long as the DaBo remains in the possession of the original Customer of the product.

WeMesh warrants DaBo to be free from defects in materials and workmanship under normal use and conditions for a period of NINETY (90) DAYS FROM THE RECEIPT OF YOUR DABO based on the shipper’s tracking information. If Customer has damaged/misused their DaBo, this Limited Warranty is immediately rendered void. The coverage of this Limited Warranty is not transferable or assignable and is available only for the original Customer of the product.

WeMesh’s limited warranty does not apply to fabric. WeMesh’s sole and exclusive obligation under its Limited Warranty is to repair or replace, at WeMesh’s option, any product that is returned to it within the applicable ninety (90) day warranty period and judged by WeMesh to be defective. In no event shall this Limited Warranty require more than the repair or replacement of any part or parts which is found to be defective within the effective warranty period. No refunds will be given. If replacement parts for defective and materials are not available, WeMesh reserves the right to make product substitutions in lieu of repair or replacement. To the extent permitted by applicable law, the WeMesh’s liability shall be limited to the purchase value of the product.

No other representations and/or warranties, either expressed or implied are made by WeMesh with respect to the products, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement or any other warranties that may arise from usage or trade or course of dealing. To the greatest extent permitted by applicable law, the warranties set forth in this Limited Warranty are exclusive and in lieu of all other warranties, express or implied. 

This Limited Warranty applies only when DaBo is purchased from WeMesh or its licensed and authorized retailers. WeMesh provides no warranty for any product sold by any unauthorized and unlicensed third party retailer or distributor. SUBMISSION PROCEDURES & REQUIREMENTS 

To exercise Customer’s rights under the limited warranty, it is the Customer’s sole responsibility to contact WeMesh at https://meshyogareturns.returnscenter.com/. The Customer must submit the original WeMesh sales receipt they received from WeMesh or its authorized and licensed retailer and as well as a brief description of the claimed defect, malfunction, or non-conformity and any photographs or other supporting documentation. WeMesh will contact the Customer with further instructions.

 

WARRANTY - SPECIFIC TERMS – DaBo, DaBo Standard Top, and DaBo Inversion Top

WeMesh’s ninety (90) day limited warranty becomes null and void and of no further legal force or effect if any such upholstered product is re-upholstered, treated with an after-market soil, fabric, or leather protection, treated with any other chemical or repaired without WeMesh’s prior written authorization.

 

Cushions: 90 Days

Cushions are warranted by WeMesh against loss of resiliency for a period of ninety (90) days. Notwithstanding the foregoing, the loss of resiliency does not include any slight softening of a cushion or the flattening of the fiber top.

 

Fabric: Not Covered Under the Warranty

Upholstery fabrics are not covered under the WeMesh warranty. While WeMesh makes every effort to select fabrics that are durable and colorfast, we regret that we will be unable to honor adjustments, claims, or credits based on durability or colorfastness. On all upholstery, WeMesh tries to align and match fabric patterns; however, the Customer is advised that in most cases tufting will not allow exact alignment and matching of fabric patterns.

 

Wood Products: 90 Days

Wood products are warranted to be free of defects in materials and workmanship for the WeMesh ninety (90) day limited warranty period. Please note that wood is a natural organic material and as such it breathes and responds to changes in humidity and temperature, and will vary in shade, texture, and markings. Such variances are not considered defects, malfunctions, or non-conformities.

 

WARRANTY LIMITATIONS AND EXCLUSIONS

WeMesh’s warranty terms reflect the superior quality of its products; however there are some necessary limitations and exclusions, detailed below.

 

Disclaimer of Implied Warranties

"Implied warranties," herein signifies warranties that the law sometimes implies to have been given by the seller of a product, good or service even though they are not set out in writing: WeMesh makes no implied warranties of merchantability or fitness for a particular purpose. These and all other implied warranties are specifically disclaimed. This Limited Warranty is the sole and exclusive warranty for DaBo. To the greatest extent permitted by applicable law, the warranties set forth in this Limited Warranty are exclusive and in lieu of all other warranties, express or implied.

 

Place of Purchase

WeMesh’s ninety (90) day limited warranty protects only the original Customer who purchases a product or products directly from WeMesh or on MeshYoga.com or from an authorized and licensed retailer or distributor. WeMesh makes provides no warranty for any product sold by any unauthorized and unlicensed third party retailer or distributor.

 

Residential Use

WeMesh’s ninety (90) day limited warranty applies only to WeMesh products purchased for only non-commercial, in-home, indoor use and does not cover any products that are used for commercial use.

 

Commercial Use

WeMesh’s ninety (90) day limited warranty does not cover any commercial use or commercial purchases of WeMesh products. There will be no warranty at all for products used commercially. Commercial use includes, but is not limited to, uses at gyms, fitness studios, personal training classes, hotels and other short or long-term rental facilities, and physical therapy or medical offices.

 

Improper Care and Use

WeMesh products require proper care and use which are essential to preserving all rights under WeMesh’s limited warranty. The WeMesh limited warranty shall be null and void and of no further legal force or effect if improper use causes damage to any product, including the use of detergents, abrasives or other harsh cleaning agents. Please see proper care and maintenance instructions provided with your DaBo product. This Limited Warranty also does not use in any manner that is inconsistent with the intended purpose or design of the product as described in the product’s usage manual or other documentation for the product, including, but not limited to, the attachment of any unauthorized accessories.

 

Indoor Use & Storage

DaBo is a product that is made for in the home and to be used and stored inside. WeMesh’s does not provide for protection against outdoor usage or storage. Any damage caused by the natural elements are not covered, and will void this Limited Warranty in its entirety.

 

Accidents, Abuse and Normal Wear and Tear

WeMesh’s limited warranty does not cover damage to products resulting from negligence, misuse, abuse, normal wear and tear, or accidents, including burns, cuts, scratches, tears, scuffs, watermarks, indentations, vandalism, pet damage, or any other damages caused by external forces.

 

Product Modification

Any modification made to a WeMesh product by any retailer, consumer, or other parties not authorized in writing by WeMesh will void the WeMesh Limited Warranty.

 

Products purchased "AS IS"

This limited warranty does not cover any product designated "AS IS" at the time of purchase.

 

Natural Product Degradation

Because some WeMesh products are hand-crafted from natural materials minor variations can occur from piece to piece, and as such this warranty does not cover such minor variations, or differences between website or marketing samples or printed illustrations and actual products delivered.

 

Consequential or Incidental Damages

To the extent permitted by applicable law, WeMesh will not be liable for consequential or incidental damages. “consequential or incidental damages” is herein defined as any loss, expense, or damage other than to the products themselves that may result from a defect in said products, including loss of business, profits, revenue, or anticipated savings. To the greatest extent permitted by applicable law, WeMesh’s liability is limited only to the original price paid for the DaBo.

 

WARRANTY RIGHTS AND ENFORCEMENT

This WeMesh Limited Warranty gives Customer specific legal rights, and Customer may also have other rights, which vary from jurisdiction to jurisdiction. The benefits conferred by this Limited Warranty are in addition to all rights and remedies provided under any such laws or regulations. Nothing in this Limited Warranty is intended to limit any consumer rights granted by such laws and regulations. To the extent that liability under such laws and regulations may be limited, WeMesh’s liability is limited, at its sole option, to replace or repair of DaBo. Some states or provinces do not allow the exclusion or limitation of incidental or consequential damages, so some or all of the above limitations may not apply to you.

Except for such other rights provided under applicable law, the remedies provided under this WeMesh Limited Warranty limit WeMesh’s responsibilities and liabilities. If any portion of this WeMesh limited warranty is deemed unenforceable by any jurisdiction or judgment than it shall not render the entire warranty null and void, but all other clauses and stipulations shall remain in full force and effect.
